ORDINANCE NUMBER 1.01

AN ORDINANCE OF THE TOWN OF BRIGHAM

TO ESTABLISH AND SET FORTH A FEE SCHEDULE

SECTION A PURPOSE, AUTHORIZATION, AND ADOPTION

The Town of Brigham Town Board has the authority to establish, and does hereby declare, the fees for all services, permits, visits, applications, administrative and other costs associated with the operation of the Town and its ordinances.

SECTION B ESCROW DEPOSIT

1 At such time as the applicant (for Zoning, Rezoning, Variance, CUP, or Driveway Permit) submits an application for review by the Plan Commission and Town Board, the applicant shall deposit with the Town Treasurer, in escrow, the sum required by the following schedule so as to guarantee the timely payment of all of the Town's fees as outlined in Section C-1 below.

(a) Applications affecting one lot: $1,500.00.

(b) Applications affecting more than one lot: $1500.00 for the first lot, and $500.00 for each additional lot.

2 In the event the amount deposited with the Town Treasurer falls below 25% of the amount required to be deposited (per Section B-1 above), the Plan Commission or the Town Board shall have the option of requiring the applicant to replenish the escrow to the original amount required hereunder.In the event the applicant withdraws the application, or same is approved, and money remains in escrow over and above the Town's fees, the excess shall be refunded to the applicant.The Town Treasurer, with the approval of the Town Board, shall have the right to draw upon the escrow to reimburse the Town for the fees it has incurred in reviewing the application on a periodic basis.An accounting of all fees incurred by the Town and the status of the escrow shall be provided to the applicant periodically.In the event the applicant defaults in establishing or replenishing the escrow, the Town shall not be required to act further upon the applicant's request.Failure to replenish the escrow shall be sufficient cause to reject the application.

SECTION C FEE SCHEDULE

1 The fees per application (for Zoning, Rezoning, Variance, CUP, or Driveway Permit) are as follows:

(a) Plan Commission Meeting (may be shared by other applicants) $280.00

(b) Special Town Board Meeting $175.00

(c) Town Chair (and others) Inspection (per person) $65.00

(d) Second and Subsequent Town Inspections (each) $100.00

(e) County Zoning Meeting (Per Town Board member attending) $65.00

(f) 2-Year Driveway renewal application (after 2 years) $25.00

(g) Field Road Site Visit (Plan Commission) (May be shared with others) $280.00

(h) Professional Services (To include, but not limited to:Lawyer, Soil Tester, Engineer (Road or other) and building inspector) $ Billed Rate

(i) Publications $ Billed Rate

j)Administrative Costs (Beyond $50) $ 35/hour

k)Final Driveway Inspection $65.00

2 Town Board Trip to the Iowa County Board of Adjustment $65.00/person

3 Inspection of Field Entrance off a Town Road $65.00

4 Other Town Charges:

(a) Copies (Blk/White) per page $0.25

(b) Copies (Color) per page $0.50

(c) CD copy $5.00

(d) Copy of Cassette Tape $10.00

(e) Real Estate Inquiries $25.00

(f) Cigarette License $25.00

(g) Beer License Class B $100.00

(h) Class C Wine License $100.00

(i) Picnic License $10.00

(j)Liquor License Class B $500.00

(k) Operator License $10.00

(l)) Public Works Charges will be charged according to State Rates & Current Rates

This Ordinance shall take effect upon passage by a majority vote of the members of the Town Board and publication as required by law.

The above and foregoing Ordinance was duly adopted at a regular meeting of the Town Board of the Town of Brigham on the 6th day of October, 2009.
